1. Acceptance of These Terms
These Terms of Service (“Terms”) govern your access to and use of all Skydimo websites, software, firmware, hardware, cloud services, and related documentation (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you accept these Terms on behalf of a business or organization, you represent that you have authority to bind that entity. If you do not agree with any provision, you must not use the Services.
2. Eligibility & Account Security
You must be at least 16 years old, or the age of majority in your jurisdiction (whichever is higher), to create an account or use the Services. You agree to provide accurate registration details, keep them updated, and maintain the confidentiality of your credentials.
You are responsible for all activity that occurs under your account. Notify Skydimo immediately at support@skydimo.com if you suspect any unauthorized access. Skydimo may suspend or terminate accounts used in violation of these Terms.
3. License to Use the Software
Subject to your compliance with these Terms, Skydimo grants you a limited, non-exclusive, non-transferable, revocable license to install and use the software elements of the Services with authorized Skydimo hardware or integrations for your personal or internal business use.
You may not copy, modify, reverse engineer, distribute, or create derivative works except as expressly permitted by law. Some components may be provided under open-source licenses; those licenses govern your use of those components.
4. Orders, Fees & Taxes
Pricing, billing cycles, and payment terms are described in the applicable order, invoice, or online listing. You agree to pay all amounts when due and authorize Skydimo to process payments through trusted third-party providers.
Unless expressly stated otherwise in writing, fees are exclusive of taxes, duties, and bank charges, which you are responsible for paying. Refunds follow the return policy for the relevant product or service.
5. Acceptable Use
You agree not to:
- Attempt to gain unauthorized access to the Services or interfere with their integrity.
- Upload malware or use the Services to transmit spam, deceptive, or unlawful content.
- Infringe the intellectual property or privacy rights of others.
- Resell, rent, or sublicense the Services without Skydimo’s written consent.
6. Intellectual Property & Feedback
Skydimo and its licensors retain all ownership rights in the Services, including software, firmware, documentation, trademarks, and logos. Except for the limited license above, no rights are granted or transferred to you.
You retain ownership of data you submit. By providing feedback or suggestions, you grant Skydimo a worldwide, royalty-free, perpetual license to use and incorporate such feedback without restriction.
7. Service Availability, Disclaimers & Limitation of Liability
The Services are provided on an “as is” and “as available” basis. Except where required by law, Skydimo disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Skydimo’s total liability arising from the Services will not exceed the fees you paid to Skydimo during the twelve (12) months preceding the claim. These limits do not apply to liability that cannot be excluded by law, such as for death or personal injury caused by negligence.
8. Termination
You may stop using the Services at any time. Skydimo may suspend or terminate your access if you materially breach these Terms, fail to pay fees, or create security or legal risks. Upon termination, your license ends and you must uninstall the software, but sections that by nature should survive (e.g., Intellectual Property, Liability) remain in effect.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. The parties will attempt to resolve disputes through good-faith negotiations. If unresolved within thirty (30) days, either party may bring the dispute before the competent courts of Shenzhen, Guangdong Province, which both parties accept as having exclusive jurisdiction.
10. Changes to These Terms
Skydimo may update these Terms to reflect new services, legal requirements, or business needs. Material changes will be communicated via email or in-product notification at least seven (7) days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
